2. Terms & Conditions

By using this website or purchasing services, you accept these Terms.

2.1 Scope of Services

The Flat Fee Agent LLC provides non-brokerage services, including but not limited to:

• Administrative support

• Photography coordination

• Lockboxes & signage

• Marketing materials

• Transaction coordination

• Vendor coordination

• Listing & buyer onboarding

eXp Realty LLC provides licensed brokerage services, including:

• Buyer & seller representation

• MLS activities

• Contract negotiations

• Texas Real Estate Commission (TREC) compliance

2.2 No Unauthorized Use

You may not copy, alter, or misuse website content, package descriptions, documents, or materials.

2.3 Communications Consent

By using the site, you consent to receive text and email updates related to your services.

3. Compensation Policy

(Buyer & Seller Fees)

3.1 Buyer Flat Fees

Buyers pay a flat fee (based on package selected) for representation through eXp Realty LLC.

3.2 Buyer Deposits

Buyer deposits are non-refundable and processed through The Flat Fee Agent LLC for non-brokerage administrative and coordination services.

3.3 Seller Deposits

Seller deposits are non-refundable and cover:

• Photography

• Lockboxes

• Signage

• Marketing setup

• Coordination

• Administrative preparation

3.4 Seller-Paid Compensation

eXp Realty LLC may accept seller-paid compensation (e.g., MLS offers).

3.5 Application of Seller Compensation

Any seller-paid compensation is applied first to the buyer’s flat fee.

3.6 Excess Compensation

If seller-paid compensation exceeds the flat fee:

The agent is authorized to retain the excess as additional compensation.

3.7 Buyer Cap

Buyer will never pay more than their flat fee (minus deposit).

3.8 Zero Cost at Closing

If the seller pays more than the flat fee:

Buyer owes $0 at closing.

4. Deposits & Refund Policy

4.1 All Deposits Are Non-Refundable

Whether paid by buyers or sellers, deposits are non-refundable because they cover upfront non-brokerage services already rendered.

4.2 Earnest Money & Option Fee

These are handled per contract terms and are not controlled by The Flat Fee Agent LLC.

5. Customer Responsibilities Agreement

Clients agree to:

• Communicate within 24–48 hours

• Provide documents promptly

• Cooperate with scheduling

• Maintain professional conduct

• Be honest and transparent

• Follow contract deadlines

• Not engage multiple agents simultaneously

• Notify the agent of major changes (finances, property decisions, etc.)

Failure to Perform

If the client fails to handle their duties in a timely manner, it may result in:

• Delays

• Loss of transaction

• Termination by The Flat Fee Agent LLC or eXp Realty LLC

6. Termination Policy

6.1 Agent’s Right to Terminate

We may terminate representation or services if client:

• Is unresponsive

• Misses deadlines

• Repeatedly cancels appointments

• Provides false information

• Acts unprofessionally

• Obstructs progress or delays the transaction

• Fails to meet responsibilities listed in the Customer Responsibilities Agreement

6.2 Effect of Termination

• Deposits remain non-refundable

• Materials must remain until removed by the company

• eXp Realty will cease representation

• Replacement fees may apply for damaged or missing items

7. Lockbox & Signage Policy

7.1 Ownership

All lockboxes, signs, riders, posts, and marketing materials remain the property of The Flat Fee Agent LLC and/or eXp Realty LLC.

7.2 Removal After Closing

We reserve the right to retrieve:

• Supra lockboxes

• Combo lockboxes

• Signage

• Signposts

• Marketing materials

These will be removed after closing or termination.

7.3 Prohibited Actions

Client agrees NOT to:

• Move, remove, damage, or tamper with any lockboxes or signage

• Change lockbox codes

• Forcefully remove or cut off lockboxes

• Dispose of signs or materials

• Paint over, cover, or alter signage

• Allow contractors to remove or damage materials

7.4 Early Removal Requests

If a client wants materials removed prior to closing:

Request must be submitted in writing by email or text.

7.5 Responsibility for Damage or Loss

Clients are responsible for any third-party damage, including:

• Contractors

• Landscapers

• Tenants

• Visitors

• Pets

• HOA workers

7.6 Replacement Fees

If materials are lost, stolen, damaged, or not returned:

• Supra lockbox: $150

• Combination lockbox: $40

• Sign panel: $65

• 6 ft signpost: $90

• Riders: $25

• Directional signs: $15 each

• Brochure box: $25

8. Liability Disclaimer

We are not responsible for:

• Vendor actions

• Inspection results

• Appraisal outcomes

• Lender delays

• HOA actions

• Title company issues

• Market conditions

• Losses caused by third parties

• Acts of God or unforeseen events

Liability is limited to the amount paid for services.

9. Compliance & Broker Disclosure

We comply with:

• Texas Real Estate Commission (TREC)

• Federal and state advertising laws

• NAR settlement rules

• eXp Realty LLC broker compliance

All brokerage compensation flows through eXp Realty LLC.

All non-brokerage service fees flow through The Flat Fee Agent LLC.
